Terms and Conditions

General terms and conditions European Food Projects Case Competition-

1. Relevance 1.1. Legally binding agreement By agreeing with the general terms and conditions, you enter a legally binding agreement and agree to be bound by these general terms and conditions.

1.2. If you do not agree with any of the statements in the general terms and conditions, you may submit a written request to European Food Projects Case Competition for different provisions. This can be done by sending an email to thefood.case.project@gmail.com. If you do not agree with any of the statements in the general terms and conditions, you may be restricted from services provided by European Food Projects Case Competition.

2. Definitions General terms and conditions: These general terms and conditions of European Food Projects Case Competition

European Food Projects Case Competition: An event organised by European Food Projects. European Food Project is a pilot project run by a group of six international team members coordinated by Tim T’Seyen

European Food Projects (EFP) website: The complete technical infrastructure and all of its capabilities that are offered through the URLs https://www.eufoodprojects.com/

Sponsor: The legal entity that uses the European Food Projects Case Competition website in order to get in touch with potential future employees for the purpose of recruitment, selection, and/or labour market communication.

External host:

The legal entity that uses European Food Projects Case Competition in order to obtain food project concepts through submissions from the participant. The concepts from the winning participants of this case competition will be used for commercial purposes by this legal entity.

Company profile: A collection of information and/or data, including, but not exclusively photos, videos and other material that is being communicated by a sponsor.

 

3. Disclaimer 3.1. Author’s rights

European Food Projects organisational team pays a lot of attention to the information on the website. Possible author’s rights on the content, shapes, images and the program are all with EFP. If you find any material on the website which you believe infringes any third party or property rights, please contact EFP. EFP cannot be held responsible for the information provided on the website.

3.2. Availability of products, services, and activities EFP cannot guarantee that the products, services and activities which are offered on the EFP website are all available at any time.

3.3. Legal liability concerning communication EFP does not accept legal liability for any communication and/or information that is or is not provided by EFP.

3.4. Legal liability concerning the use of the EFP website EFP will not accept legal liability for any damages resulting from the use of the European Food Projects Case Competition website.

4. Information

4.1. Submitting information When signing up, you are asked to provide European Food Projects Case Competition personal information. Details submitted to European Food Projects Case Competition are under the responsibility of EFP.

4.2. Use of information EFP uses the information to be able to improve the services European Food Projects Case Competition offers.

5. Events

5.1. Changes in the programme EFP retains the right to make changes to event programmes at all times. EFP will do everything within its power to ensure the offered components will take place.

5.2. CV selection Some European Food Projects Case Competition events include a CV selection. Through the use of CV selection, the sponsor can choose candidates who match with its preferred job profile and wishes. (i) EFP handles your personal details very confidentially and will, apart from making your CV anonymous, not apply any changes. In the process of making your CV anonymous, we will remove your contact details (i.e. telephone number, address, city and e-mail). (ii) EFP can in no way influence the selection of candidates. Exclusively the participating sponsors will execute the selection of candidates. (iii) EFP is in no way responsible when a sponsor in which the candidate is interested does not select a candidate.

(iv) When there are conflicts within the EFP event programme, a CV selection component will outweigh a component without CV selection. In addition, individual conversations are considered more consequential than a case with CV selection.

(v) After the candidate participated in (parts of) an EFP event devoted to a specific sponsor including CV selection, EFP has the right to hand over the full CV from that student to that particular sponsor

5.3. No-Show policy

5.3.1 Career Events

Participating in a career event is free. To give everyone a fair chance to participate in popular activities, we apply a no-show policy. The policy contains the following rules:

(i) If you unsubscribe at least 7 calendar days before the day of the submission takes place, you will not get a participation certificate, but you won’t receive a penalty. Beware: only cancellations before 12 PM CET will be accepted.

(ii) If you unsubscribe later than 12 PM CET, 7 calendar days days before the submission deadline, you will not get a participation certificate and you will not be eligible for any benefits attached to activities organised by EFP.

(iii) If you submit your project on the primary slide, but do not add your secondary slide within 3 calendar days from the moment that you are selected as the winner, you will not receive any monetary prize. You will also not be eligible to join the next iteration of the case competition.

(iv) If you submit your project after the submission deadline, your project will not be taken into account and thus will not be graded. You will not be eligible for any benefits attached to the participation of the case competition organised by EFP.

For example: If you are registered for the EFP Case Competition on 15th of a month, you need to de-register at least before 12:00 midnight on 7th of the same month in order to not get a penalty. If you de-register at 00:01 AM on 8th of that same month, this means you won’t receive a participation certficate and your concept will not be taken into account.

Please keep in mind that we are strict regarding late cancellations or no-shows, because of the arrangements we have made with our partners.

5.4. Special circumstances In case of special circumstances, such as the cancellation of an EFP event, EFP will inform the participants as soon as possible. In case of the cancellation of an EFP event because of circumstances beyond EFP’s control, EFP is not liable to refund and compensation the participation fee.

6. License 6.1. License By uploading or sending data to EFP, you grant EFP an irrevocable, unconditional, worldwide, unlimited, perpetual and royalty-free licence to use this data, or any part thereof, in any way it deems appropriate, in some or all media. Moreover, in doing so, you renounce your moral rights (including, without limitation, rights of attribution and integrity) regarding the data. In the event that EFP would sell or transfer its – or part of its – business activities to a third party, EFP has and maintains the right to also sell and/or transfer your data.

7. Use of the European Food Projects website 7.1. Entitlement to use the EFP website By agreeing with the general terms and conditions, you guarantee that you are entitled to make use of the European Food Projects website, and that you act in compliance with these general terms and conditions.

7.2. Website use for commercial purposes It is explicitly not allowed to use the EFP website for direct or indirect purposes. That includes using, exporting, saving, and/or processing contract details of European Food Projects sponsors and/or any data and/or information displayed on a European Food Projects sponsor’s company profile for any commercial purpose.

7.3. Duplicating and/or making information public It is not allowed to use the information you receive from either EFP or a sponsor of EFP for other than personal objectives. The information may not be used for any other purpose, including duplicating it or making the information public without prior written permission from EFP.

7.4. The use of the EFP website in an automatic or manual manner The EFP website is meant to be used for personal objectives by normal browser-use. It is hence not allowed to use the (data available on the) website or to access the data on the EFP website through the use of other technology or software. Hyperlinks should lead directly to the context, within which EFP offers content. It is also not allowed to circumvent and/or to remove any technical security on the EFP website or make this possible for others.

7.5. Responsibility for the information available on the EFP website By agreeing with the general terms and conditions, you accept that you carry the responsibility for the content and nature of all information that you fill out, upload, and/or communicates on the EFP website.

7.6. Other restrictions regarding the use of the EFP website Regardless of any other terms within these general terms and conditions, you are not permitted to use the EFP website: (i) for any unlawful cause; (ii) in any way resulting in a diminished functionality of the European Food Projects

website or that may cause damage to the functionality of the European Food Projects website; (iii) for spreading, sending or uploading computer viruses or other files or software that cause damage to the European Food Projects website, other European Food Projects a members, and/or European Food Projects sponsors; (iv) for spreading, sending or uploading material that is slanderous, insulting, obscene or threating of nature or that may lead to irritation, inconvenience or unnecessary commotion; (v) in a way that results in an infringement of any right of any person or legal entity; (vi) for spreading any material with the purpose of gaining publicity, promotion and/or advertising without the written permission of European Food Projects.

8. Intellectual Property Rights 8.1. Intellectual property rights By agreeing with the general terms and conditions, you acknowledge that all copyrights, trademarks and all other intellectual property rights that are part of the European Food Projects website, that become and are property of European Food Projects, will remain property of European Food Projects and are part of the copyrights, adjacent rights and database rights of European Food Projects and other applicable rights as trademarks.

8.2. Not allowed to download, copy, alter or make public It is explicitly not allowed to download, copy, alter or make public any files, software and/or materials that are available on the European Food Projects website for direct or indirect commercial purposes or for any purpose other than those described in article 5, unless prior written permission is given by European Food Projects.

8.3. Not allowed to copy, alter or use source code It is not permitted to copy or alter the source code of the European Food Projects website, to use it as the basis for any work or to try to retrieve the source code in any way or sell, vest, sub-license, transfer or establish any right on the information or source code.

8.4 Intellectual Property rights of the concepts submitted by the candidate as part of the Case-competition

By joining the case-competition, you agree that your submission will be sent to the external company that hosts the competition. The submission of the food concept does not guarantee that you win a monetary prize nor does it guarantee you any internships nor professional gain. You agree that the winners will be decided by the company representatives or their delegates based on the criteria that were described and stated in the appendix of the case study document under the part ‘Case-competition evaluation criteria’. The participant will receive this document at the beginning of the case competition. If your concept is chosen as the winner, you are obliged to send in the secondary slide in order to receive the monetary price. Once the secondary slide is submitted, the participants agree that the information which is included within both slides can be utilized by the company for commercial purposes. The participant agrees that the

monetary prize is the compensation that they will receive for their work. The participant understands, agrees and hereby assigns and transfers to the external host all rights, title, and interest, including all intellectual property rights, in the concept and all related materials, as of the date the secondary slide is submitted. The participant will not claim any other compensation regarding this intellectual knowledge. The participant will not be eligible for the potential profit that the external hosts makes from commercializing his or her food concept submission. The price will be transferred to the winning participant within 90 working days of officially announcing the winner.

9. Privacy 9.1. Bound by Privacy Policy By agreeing with the general terms and conditions, you are bound by our Privacy Policy.

9.2. Privacy Policy EFP values the privacy of its members. Protecting the members’ privacy is at the core of the EFP business. Therefore, EFP keeps the information that EFP members provide to EFP secure and confidential. More information can be found in the Privacy Policy.

9.3. Permission to process data By agreeing with the general terms and conditions, you allow EFP to process the data that you fill out or uploads to the European Food Projects website and to incorporate these into one or more files.

9.4. Permission sending notifications By agreeing with the general terms and conditions, you allow EFP to send messages to the email address that you filled out on the European Food Projects website, in the context of notifications of European Food Projects sponsors and updates of any significance. You can unsubscribe for notifications while continue to be a EFP member by sending an email to thefood.case.project@gmail.com

9.5 Permission to take and use pictures By agreeing with the general terms and conditions, you allow EFP to take pictures of you onEuropean Food Projects events, and to upload and use those on the European Food Projects website or any other promotional outings.

9.6 Insight in personal data Whenever a member wants to have insight in his or her personal data obtained by EFP, he or she can contact EFP by sending an email to thefood.case.project@gmail.com

9.7 Removal of personal data Whenever a participant wants to remove his or her personal data from the European Food Projects membership database, this can be done by sending an email to thefood.case.project@gmail.com with a formal statement to remove all your personal data.

10. Applicable law, choice of court, void and voidable terms 10.1. Polish law The general terms and conditions is governed by Polish law. Polish law is applicable to all contracts and agreements that involve EFP as a party. All disputes which may arise from the general terms and conditions shall be settled by the competent Polish court.

10.2. Choice of court EFP is authorized to, yet not obliged to, present potential disputes that cannot be settle or concluded in any other way, to the Polish Court in the living area of the location of EFP.

10.3. Void or voidable term In the event one or more terms of the general terms and conditions are void or voidable, the concerning term will be replaced by a valid provision that has the same effect.

10.4 Changes EFP has the right to change the general terms and conditions of European Food Projects in any moment in time when EFP considers this as necessary, without prior notice. The new general terms and conditions will be published on eufoodprojects.com and members are recommended to check the website regularly.
